40/40 Club Incident


A clubgoer at rapper Jay-Z's popular Chelsea
nightspot was arrested for rape early yesterday after a woman claimed
she was attacked in one of the club's unisex bathrooms,
law-enforcement sources told The Post.
Mario Valenzuela-Caranz, 22, of Nutley, N.J., was hauled off by cops
as he left the 40/40 Club on West 25th Street around 12:35 a.m.
yesterday - after friends of his alleged victim called police, a
source said.
After speaking with the alleged victim - identified only as a
21-year-old from Connecticut - District Attorney Robert Morgenthau's
office late yesterday decided to charge him with rape, a source said.
Sources said the woman "admitted she went voluntarily" into a unisex
bathroom with Caranz - whom she had just met that night.
But then things turned violent, the victim reportedly told law
enforcement.
"She admitted to consensually embracing him - and to having oral sex,"
said one source.
The woman claimed "that's all she wanted to do" but Caranz "kept
forcing himself" on her, said the source.
"She said she tried to stop him [but] he raped her."
Emerging from the bathroom, the woman told friends about the encounter
- and they immediately called cops, according to a source.
The alleged victim was described by one source as "a reluctant
complainant."
Word of the charges came as a surprise to Jay-Z and his partners.
A club spokesperson said management had just learned of the incident
late yesterday and declined comment.
However, the rep noted that the club - which opened in May - has never
had a police incident, and, like other clubs with unisex facilities,
has security officers guarding the bathrooms.
Meanwhile, a witness to the early-morning arrest said the incident
"looked more like it was a boyfriend-girfriend dispute," adding that
police "were really pushing the girl to press charges."
Grammy-winning Jay-Z - who recently said he's retiring from
record-making - opened the upscale, sports-themed 40/40 Club last summer.
The opening-night bash drew Jay-Z's girlfriend, Beyonce Knowles, Magic
Johnson, Lil' Kim and Jason Kidd to the 8,000-square-foot, $4 million
space.
